Signal receiver distribution terms & conditions

In order to facilitate ease of connections, preferably at the time of installation of air-conditioner unit(s), Energex can provide you/your company with PeakSmart Signal Receiver stock to provide your customers and/or installation network.

By placing an order for PeakSmart Signal Receivers you agree to the following terms and conditions in relation to ordering, receipting, stock control, dispatch tracking, the Signal Receiver device and return of stock.

1. Ordering
   1. You will place orders commensurate with your sales of PeakSmart Compatible Air-conditioners and the percentage of those sales you estimate where the purchaser will want to participate in the program;
   2. You will place orders in advance to ensure continuity of stock (delivery of stock may take up to 5 business days).
2. Inwards Goods Receipting
   1. You confirm you have suitable processes in place to track each Signal Receiver we delivered to you; and
   2. You confirm you have the capability to check Signal Receiver stock against the Signal Receiver serial numbers we delivers to you.
3. Stock Control
   1. You confirm you have the ability to store the Signal Receivers in a secure location;
   2. You confirm you have the ability to track the Signal Receivers you deliver to customers by plant (serial) number; and
   3. You commit to provide to us a minimum monthly reconciliation of Signal Receiver stock and when requested by us.
4. Signal receiver dispatch tracking
   1. You only provide Signal Receivers to customers and/or installers who have confirmed to you their intention to have the Signal Receivers installed in a PeakSmart Compatible Air-Conditioner;
   2. You will track and match the plant (serial) number of each Signal Receiver delivered to each customer and/or installer;
   3. You will contact your customers and/or installers to provide an update on why their application has not been received by us (as requested); and
   4. You will request that customers and/or installers return uninstalled Signal Receivers to us.
5. Signal receiver device
   1. You will not alter or remove any items from the package in which the Signal Receiver is delivered to you;
   2. You will not charge customers for the Signal Receiver; and
   3. You agree that the Signal Receiver at all times remains the property of Energex.
6. Return of Stock
   1. You acknowledge that Energex reserves the right at any time to request the return of Signal Receiver stock;
   2. You will undertake a final reconciliation of stock which must be conducted and provided to us within 10 business days; and
   3. You will return all remaining Signal Receiver stock to us promptly (not more than 10 business days after providing the final reconciliation to us).

By placing an order for Signal Receiver stock you do so in line with the terms and conditions outlined above. You will not be authorised to act on Energex’s behalf in any way, or to make any representations on our behalf to customers, installers, appliance retailers or any other persons.
